As of July 25, 2025, USA Fencing’s Transgender & Non‑Binary Participation Policy mandates that women’s fencing events are limited to athletes of female sex assigned at birth, in alignment with the U.S. Olympic & Paralympic Committee’s updated policy following Executive Order 14201 ("Keeping Men Out of Women’s Sports") (See https://www.usafencing.org/transgender-and-nonbinary-policy)
This is in direct contrary to the Minnesota Human Rights Act (MHRA) (https://mn.gov/mdhr/yourrights/mhra/). In summary:
Federal Directive (USA Fencing)
- Effective August 1, 2025, USA Fencing requires athletes to compete based on birth-assigned sex, effectively excluding transgender women from women's fencing events—even at local, regional, and national levels.
Minnesota Human Rights Act (MHRA)
- The Minnesota AG issued a formal legal opinion stating that a federal executive order cannot override Minnesota’s protections for gender identity under the MHRA
- Barring transgender individuals from participating in sports consistent with their gender identity is explicitly prohibited by Minnesota law.
What the Minnesota Division is Doing
Due to this regulatory conflict, the Minnesota Fencing Division is formally seeking guidance and clarification from authoritative legal entities. They are determining how to reconcile:
- USA Fencing’s male-sex-only women's category
- Minnesota’s anti-discrimination statutes protecting transgender participation

Policy Update from RYF/RMSA – Effective ImmediatelyDue to the ongoing conflict between USA Fencing's Transgender & Non-Binary Participation Policy and the Minnesota Human Rights Act, and until further guidance is issued by the Minnesota Division, the following changes are in effect:
- All mixed-gender events will continue to be sanctioned under USA Fencing regulations.
- All women-only events will be conducted as unsanctioned to ensure compliance with Minnesota civil rights protections.
This temporary measure reflects RYF/RMSA’s commitment to both athlete inclusion and regulatory compliance, and will be revisited as soon as official clarification is provided.
